I think HPQ will face a huge challenge here.
1. They have to prove Mark Hurd is going to release those confidential info (which he has not done so)
2. Can Oracle put him in a restructuring role to oversees M&A?
- I think yes. After all, Mark Hurd has slashed lots of costs for HPQ and return it to profitability.
- So Mark Hurd can be deploy to oversee the restructuring of SUN.
- how about 2 years of restructuring? Enough time to see that any agreement has expired?
3. If relationships between HPQ and Oracle goes south, what will HPQ ends up with?
- No database?
- look to IBM for database?
- How about Java (which Oracle owns through the acquisition of SUN)?
Anyway, such lawsuits are common between tech giants.
